Insurance claims
Herminius was commissioned to help a lead insurer and the following market assess its potential liability stemming from the loss of a US$70m Afrimax tanker, which had disappeared and later resurfaced as a flagship vessel of the navy of the Iranian Revolutionary Guard Corps. Insurers needed to determine the likelihood of the validity of the claim, which had been made under two clauses of the governing framework; the probability of a successful defence of the claim; and the extent to which it should provision for either a settlement or total loss. Working with external counsel and through a combination of external intelligence, in-house expertise and the provision of an expert witness at the hearing, Herminius was able to determine the detailed circumstances and events that led to the claim, and demonstrate that on the balance of probabilities the claim was not valid. The courts dismissed the claim on both counts.
